Línea jurisprudencial del consejo de estado sobre la prevalencia del principio constitucional de buena fe sobre la solemnidad del contrato estatal

Abstract

En la presente investigación se analizará la evolución jurisprudencial del Consejo de Estado, para el reconocimiento del enriquecimiento sin justa causa en materia de responsabilidad estatal, teniendo en cuenta la prevalencia del principio constitucional de la buena fe, derivada de la prestación de servicios, el suministro de bienes y la ejecución de obras a favor del Estado sin formalización de un contrato estatal, hecho que genera para el contratista un empobrecimiento y con respecto a la entidad pública un enriquecimiento correlativo injustificado, basado en la confianza legítima que ostenta la administración. Para tal efecto, se realizará un breve repaso de los antecedentes históricos en la temática propuesta; se revisarán sus conceptos, requisitos y presupuestos establecidos por la jurisprudencia, y por último, se señalará la posición actual del Consejo de Estado sobre la aplicación de la tesis del enriquecimiento sin causa y la procedencia de la acción in rem verso en materia de responsabilidad estatal cuando no se formalice el contrato estatal, en contraposición al principio de buena fe.

The present investigation will analyze the jurisprudential evolution of the Council of State, for the recognition of enrichment without just cause in matters of state responsibility, taking into account the prevalence of the constitutional principle of good faith, derived from the rendering of services, the supply of goods and the execution of works in favor of the State without formalizing a state contract, a fact that generates impoverishment for the contractor and an unjustified correlative enrichment based on the legitimate trust held by the administration. For this purpose, a brief review of the historical background in the proposed theme will be made; its concepts, requirements and budgets established by the jurisprudence will be reviewed, and finally, the current position of the Council of State will be indicated on the application of the thesis of enrichment without cause and the origin of the action in rem verso in matters of state responsibility when the state contract is not formalized, as opposed to the principle of good faith.
